We're glad you've purchased a product that includes our software! The product cannot be used without your access to DCS EntryGo Services. That is why we need to sort out our relationship.
What follows is the legal agreement between you and Swissprime Technologies AG, Switzerland, (hereinafter “SPT”). Please read these terms (the “Terms”) carefully before using the Services.
These terms govern your access to and use of DCS EntryGo software and services through our websites and mobile applications.
This contract is governed exclusively by Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980 (Vienna Convention) and the international conflict of law rules of the Federal Act on International Private Law.
The exclusive place of jurisdiction is the courts at the headquarters of SPT, Switzerland.
1. WHAT IS DCS ENTRYGO?
SPT offers services called “DCS EntryGo” via the website www.entrygo.schueco.com or the DCS EntryGo mobile applications (the “Application (s)”). Both the Site and Application are referred to as the “Site” below. The site comprises all software and services that we offer and is referred to as the “Services” below.
The services include storing your personal information online in accordance with the Privacy Policy and the ability to manage and share your information. Data from the products, such as battery status or logs that include our technology, is uploaded to the Services. Please see our privacy policy for full details: https://www.entrygo.schueco.com/privacy-policy.
Your personal information is used a) to provide, manage, and improve our services, b) to fulfill your requests, c) to personalize your experiences, d) to provide service announcements, e) to provide you with further information and offers from DCS EntryGo or Swissprime Technologies, to manage advertising efforts and to comply with our legal obligations.
2. SET UP YOUR USER ACCOUNT
Get started by signing up for a user account for the service. Please ensure that the information you provide in the account registration form (the “Registration Information”) is accurate and complete. Your registration information is uploaded to the Services, including your email address. By doing so, you grant us the right to use your registration information and any other information you provide in connection with the operation of the website. This use is carried out exclusively in connection with the operation of the site. Your email address is used by us to send you notifications and other account-related communications.
You are responsible for all uses of your account and login information, whether or not you have authorized them. So make sure you use strong passwords (such as those that include uppercase and lowercase letters, numbers, and symbols) and always keep your password private.
Please notify us immediately if you become aware of any unauthorized use of your account, login information, or password. In such a case, change your password immediately to prevent further unauthorized use.
3. LICENSE AGREEMENT AND UPDATE SERVICES
Subject to these terms, SPT grants you a non-transferable, non-exclusive right (without the right to sublicense) to access and use the Services by (i) using the Site in conjunction with controlling and monitoring the devices installed on your property or to which you have valid access rights, and (ii) the applications on your own mobile device (such as iPhone or Android smartphone) for those under (i) install and use for the above purposes.
We may update the Services from time to time, such as by providing bug fixes, new features, or changes (collectively, “Updates”). Updates may be performed and downloaded from time to time to ensure security updates, fix bugs, etc. If you do not agree, please stop using the Services as security may no longer be adequate. SPT may release mandatory updates that require you to update your readers and devices so that the service can continue to be used. We may also ask you to install updates yourself and you agree to do so immediately. Updates are subject to these terms, together with any additional terms that may be made available with such update. Your continued use of the service is your agreement to all such additional terms.
If you don't immediately install the updates we make available to you, the service may not be able to function properly. SPT disclaims any liability for such damage or impairment.
4. CONTENT ON THE SERVICES
The content you find in connection with the Service (including but not limited to text, data, graphics, images, video, audio, and other materials (collectively, “Content”) may be protected by copyright laws of Switzerland and other countries.
You are solely responsible for any content that you upload or that you contribute to the Services in any way, such as images, geographic information, personal information, etc.; you represent and warrant that you have all necessary rights to do so in the way you contribute; and you license SPT all necessary rights to use in and to such content to use and publish on the Service in accordance with these Terms and our Privacy Policy. In particular, you agree that we may use your profile picture to show it to guests you have invited or the host who has invited you.
We are not responsible or liable for content posted by third parties on the Services, including content posted by other members (“Third Party Content”).
Unless we have expressly agreed, you may only use the content for your personal use in connection with the Services and may not distribute, modify, or create derivative works from content. Using the Services does not transfer any ownership rights to the content. Please note that personal images are protected under Swiss law and that you are not allowed to use other users' personal images.
We reserve the right to remove any content from the service at any time for any reason (including but not limited to intellectual property claims) or without any reason.
They recognize and protect the intellectual property such as know-how, registered trademarks and trademarks and copyrights of SPT and any licensors.
5. SYSTEM REQUIREMENTS
Using the service requires: (i) a valid user account; (ii) mobile clients such as a supported telephone with a working data and Bluetooth connection; (iii) supported smart cards; (iv) other system elements that can be specified by SPT.

It is your responsibility to ensure that you have all required system elements and that they are compatible, up to date and correctly configured, and that the device is always equipped with a fully charged and ready to use battery. You acknowledge that the services may not function as described if requirements and compatibility are not met.
6. THE DCS ENTRYGO PLANS
We offer various plans (the “Plans”) with additional features to meet your needs when using the Service. However, you can use most, but not all, devices without subscribing to a plan.
By subscribing to and paying for a Plan, you are eligible to use the Services as specified in the Plan for the agreed period of time (the “Period”). The plan is automatically renewed at the end of the period. If you don't cancel your plan before the renewal date, we'll charge you the amount due for another period of subscription to the same plan.
You can cancel a plan at any time, but no refunds will be made for the period that then runs. So make sure you unsubscribe from your plan well in advance if you don't want to renew it for another period of time.
7. GUESTS
These conditions also apply to all uses of the services by guests.
A “guest” is any natural or legal person who receives permission from the owner or controller of a device to use the device and the services associated with the device. Please be sure to only invite people you trust as guests; by inviting someone as a guest, you give them the option to access and operate your device.
Your personal information, mobile phone and service information may also be shared with guests, such as your name and device location, and device status (locked, unlocked, etc.).
If you invite a guest to use your device or services, you are responsible for their use and for any damage they may cause to you, SPT, or even third parties. Therefore, choose your guests carefully!
If guests are invited as users, they must set up a user account just like any other user, and by doing so, they agree and accept these terms and enter into a legal contract with SPT. You can also invite guests without them having to create a user account themselves. With the use of the appropriate functionalities, these terms of use also apply to your guests.
Guests should also be aware that the owner or controller of the device is able to see all information about their use of and access to the device and services and may revoke or restrict access rights in their sole discretion without notice.
8. THIRD PARTY WEBSITES, DEVICES AND SERVICES
The service may include links, interfaces, and content and data from third-party websites, products, and services (“Other Services”), as defined in the Privacy Policy (https://www.entygo.schueco.com/privacy-policy).
All other services are provided solely as a convenience to you. We are unable to control such other services. We do not endorse the materials contained in the Other Services nor are we responsible for the performance of the Other Services. You understand and agree that SPT makes no representation or warranty as to the security of the Other Services. Accordingly, SPT is not responsible for your use of Other Services or for any damage or other harm or loss arising from or related to your use of Other Services.
By accessing or using these Other Services, you agree to interface with these Other Services and agree that SPT may share information and control data with these Other Services. Once this information is shared with the Other Services, its use is subject to the third party's privacy policy and terms.
SPT makes no warranty, endorsement, warranty, or responsibility for products or services advertised or offered by third parties through or in connection with the devices or services (including but not limited to “Other Services” or third-party products and services connected through our Services), or for linked websites or services.
9. YOUR USE OF THE WEBSITE AND SERVICES
You agree to use or allow the Site and Services to be used only for lawful purposes and in a manner that does not infringe the rights of others and does not restrict or impede the use and enjoyment of the Site or Services. We may, in our sole discretion, monitor the use of the Service or any content to operate the Service and ensure compliance with these terms.
You may not use the Services in any way that, in our sole discretion, could damage, disable, overburden, or impair the Services.
You may not interfere with or damage the operation of or use of the Services by other users in any way, including uploading or otherwise spreading viruses, worms, or other malicious code.
You may not remove, circumvent, disable, damage, or otherwise interfere with any security-related features of the Services, features that enforce, circumvent, disable, damage, or otherwise interfere with restrictions on the use of the Services.
You must not attempt, through hacking, password mining, or other means, to gain unauthorized access to the Services or any part of them, to other accounts, computer systems, or networks connected to the Services or any part of them, or to interfere with the proper functioning of the Services or activities performed on the Services.
You may not modify, reverse engineer, develop, or otherwise translate, rent, or otherwise make available to unauthorised persons the Services and Applications.
You may not obtain or attempt to obtain any material or information by means not intentionally provided through the Services. You agree not to modify the Services in any way or form and not to use modified versions of the Services, including but not limited to gain unauthorized access to the Services.
You are responsible for any breach of these terms and, in particular, of these terms. In addition, we reserve the right, but have no obligation, to remove or suspend your access to the Services or the content contained therein at any time and without notice, particularly if, in our sole discretion, we deem content offensive or a violation of these terms. See also the “Term and Termination” section below.
10. TERMINATION AND SERVICE CHANGES
These terms apply as long and for any use of the device by our services, regardless of whether or not you have subscribed to a plan.
Subscriptions will be renewed on a monthly basis if you do not cancel the respective subscription in good time by the end of a month.
We reserve the right to suspend or terminate your use of the Services or access to the Site at any time and with immediate effect if we determine — in our sole discretion — that your use of the Services is inconsistent with these Terms or that you use the Services in a way that would make us legally liable or interfere with others' use of the Services. In the event of immediate termination of this Agreement, you will not be entitled to a refund, in whole or in part, whether in respect of the price paid for your device or for the plan you have subscribed to.
SPT makes no warranty as to the continuation of the service. We may be forced to shut down the service for various reasons, including economic, technical or other reasons. In such a case, you are not entitled to compensation of any kind.
If you transfer your device to a new owner, please note that your account is not transferable and the new owner must sign up for a separate account to use the Services. There will be no refund.
11. LIMITATIONS OF WARRANTY
We are committed to making the services highly reliable and available. SPT does not guarantee that the Services will be uninterrupted or error-free. They may be unavailable for various reasons beyond SPT's control, as our services rely on various interoperations over which we have no control. These third-party products and services (such as your Wi-Fi and mobile network and network coverage restrictions, problems with our service provider and force majeure, but also everyday situations such as having your mobile device locked for some reason) may not always function reliably and may interfere with how the services work. SPT is not responsible for damage or loss due to potential downtime of these third-party products and services.
To the extent permitted by law, SPT is not responsible for damage or liability caused by (i) use of the device and services for purposes other than those for which the device and services are designed or intended, or use in unsuitable temperature, humidity, or other environmental conditions, or use of the services in violation of SPT's written instructions (which may be provided at time of purchase or on the website), (ii) normal wear and tear, or Ageing or improper repair, operation or maintenance, or connection to an incorrect power supply, or the use of unsuitable batteries, as permitted by law.
You assume the entire risk associated with the suitability, installation, and performance of the lock and other components, hardware, software, and services provided by third parties. You must also ensure that your device is always equipped with a sufficiently charged battery or is connected to an appropriate power supply. We can, but are not required to, send you notifications via email or push message (if you have enabled this feature in your account settings) when the Services register a low battery charge. Regardless of this service, it remains your responsibility to replace a weak battery.
12. DATA PROTECTION
SPT is committed to complying with applicable data protection laws, in particular the Swiss Data Protection Act. Appropriate technical and organizational measures have been taken to ensure data security. For more information on how we process your data, please see our privacy policy.
If SPT processes personal data on behalf of you, the agreement on order data processing by SPT is applicable to the corresponding processing.
13. LIMITATIONS OF LIABILITY
SPT is liable for damage caused by intent or gross negligence, as well as for personal injury. In addition, to the extent permitted by law, SPT is not liable for any direct, indirect, or sequential damages (including but not limited to loss of use, data, business, or profit) arising from a slight or medium negligent breach of this Agreement.
Liability for vicarious agents is completely excluded.
14. CHANGES TO THE CONDITIONS
SPT may change these terms from time to time. You will be notified in advance by reasonable means. Your continued use of the Services following the effective date of the amended terms means that you agree to and be bound by the amended terms.
The latest version of these terms will be posted on the Services.
15. SEPARABILITY AND MISCELLANEOUS
If any provision of this Agreement is unlawful, void, or for any reason unenforceable, that provision shall be severable from these terms or abridged to the extent permitted by law. Such a clause does not affect the validity and enforceability of the remaining provisions.
The headings and sections are for convenience only and have no legal effect.
SPT may sell, transfer, or otherwise share some or all of its assets and obligations, including your personal information, to a third party in connection with a merger, acquisition, reorganization, or asset sale.
Swissprime Technologies AG may only sell data to third parties if it is irrevocably anonymized before transfer.
